Research Use Only Policy

1. Intended purpose

All products sold on nova-biolabs.com (the "Research Products") are designated Research Use Only ("RUO"). They are intended solely for:

In vitro laboratory research,
Basic scientific or pharmaceutical research, or
The development, validation, or qualification of analytical methods and assays.

Research Products are not intended, designed, packaged, or sold for the diagnosis, treatment, cure, mitigation, or prevention of any disease or condition in any human or animal. They are not pharmaceutical drugs, dietary supplements, cosmetics, food, or medical devices.

Research Products have not been evaluated or approved by the UAE Ministry of Health and Prevention (MOHAP), the Dubai Health Authority (DHA), the Department of Health – Abu Dhabi (DoH), the U.S. Food and Drug Administration (FDA), the European Medicines Agency (EMA), or any other regulatory authority for human or veterinary use. Using these products in humans or animals can cause injury, illness, or death.

Misusing Research Products may also be illegal in your jurisdiction.

2. Mandatory acknowledgement

This Policy must be affirmatively accepted at site visit via a mandatory, unchecked-by-default checkbox. The acceptance, the customer's IP address, and the timestamp will be logged and retained for compliance and audit purposes.

By ticking the box at checkout, the customer irrevocably confirms and agrees that:

The customer is at least twenty-one (21) years of age, or the age of majority in their jurisdiction, whichever is greater.
The customer has read, understood, and accepts the NOVA Labs Terms of Service, Shipping Policy, Returns & Refunds Policy, Privacy Policy, Website Use Policy, and this Research Use Only Policy.
The customer is purchasing Research Products solely for in vitro laboratory research use. The customer will not administer, ingest, inject, inhale, apply, reconstitute for human use, or otherwise introduce any Research Product into a human or animal body, and will not permit any other person to do so.
The customer understands that Research Products are not pharmaceutical drugs, not dietary supplements, not cosmetics, not food, and not medical devices, and have not been evaluated or approved by MOHAP, DHA, DoH, FDA, EMA, or any equivalent regulatory authority for human or veterinary use.
The customer represents that their purchase, possession, importation, storage, handling, and use of these Research Products is lawful in their jurisdiction, and that they bear sole responsibility for compliance with all applicable laws, including customs and import regulations.
The customer is not an employee, agent, or representative of any regulatory authority, intellectual property enforcement firm, or law enforcement agency acting in an investigative capacity, and is not purchasing on behalf of any such party.
The customer assumes all risk associated with their use of the Research Products and irrevocably releases, indemnifies, and holds harmless NOVA Labs, its directors, officers, employees, suppliers, and affiliates from any and all claims, losses, damages, or liabilities arising from such use or misuse.
The customer agrees that any dispute arising out of or relating to the purchase or use of Research Products will be resolved by binding arbitration seated in the Dubai International Arbitration Centre (DIAC) under the DIAC Arbitration Rules, and the customer waives any right to participate in any class or collective action.

3. Verification & order cancellation rights

When purchasing Research Products on this site, the customer agrees that the statements made herein are true and factual, and consents to:

IP address logging and verification,
Requests for authentication of any information provided (including proof of research affiliation or institutional address), and
Other verification methods undertaken by NOVA Labs in its sole discretion.

NOVA Labs reserves the right, in its sole discretion and without liability, to:

Cancel any order at any time,
Refuse to ship to any address,
Suspend or terminate any customer account, and
Report the matter to the appropriate UAE or international authorities,

where the customer has provided false information, breached this Policy, or where NOVA Labs has reasonable grounds to suspect the products are intended for use outside the scope of in vitro research.

Unapproved and improper use of Research Products constitutes a breach of this Policy and of NOVA Labs' Terms of Service, and may constitute a breach of UAE law and the laws of the customer's jurisdiction.

4. Submission of research data

By purchasing Research Products on this site, the customer agrees to submit, at least once annually through their customer account, a brief summary of at least one research study or set of experimental results in which the Research Products were used. This submission is required for quality control, product improvement, and community research purposes, and to keep the customer's researcher validation status active.

Submitted data may be retained and used by NOVA Labs in anonymised, aggregated form. NOVA Labs will not publish or disclose any individually identifiable submission without the customer's prior written consent.

5. Indemnity & release

The customer irrevocably releases, indemnifies, and holds harmless NOVA Labs, its directors, officers, employees, suppliers, and affiliates against any and all claims, damages, losses, costs, and expenses (including legal fees) arising from:

The customer's use, misuse, storage, handling, or onward supply of any Research Product;
The customer's breach of this Policy or of any applicable law; or
Any claim brought by a third party arising from the foregoing.

Nothing on this website or on any product label constitutes medical, pharmaceutical, or professional advice, and no statement made by NOVA Labs has been evaluated by MOHAP, DHA, DoH, FDA, EMA, or any equivalent regulatory authority.

6. Governing law & disputes

This Policy is governed by the laws of the United Arab Emirates and, to the extent applicable, the laws of the Emirate of Dubai, without regard to conflict of laws principles.

Any dispute arising out of or relating to this Policy shall be finally resolved by binding arbitration seated in Dubai, United Arab Emirates, administered by the Dubai International Arbitration Centre (DIAC) under the DIAC Arbitration Rules in force at the time of submission. The language of the arbitration shall be English. The customer waives any right to participate in any class, collective, or representative action.
